These Terms and Conditions govern your purchase of products and use of services from Lone Star Horns, located in Aledo, Texas. By placing an order, visiting our store, accessing our website, or otherwise engaging in a transaction with us, you agree to be bound by these Terms.

These Terms constitute a binding agreement between you and Lone Star Horns LLC. If you do not agree with any part of these Terms, please do not purchase products or use our services.

2. Products and Availability

• All products are subject to availability. We reserve the right to discontinue any product at any time.
• Descriptions, specifications, photographs, and pricing are provided for general information only and may contain errors. We make reasonable efforts to ensure accuracy but are not liable for typographical, photographic, or descriptive errors.
• Used, vintage, or consignment instruments are sold "as-is" unless explicitly stated otherwise in writing. We provide no implied warranties beyond any manufacturer's warranty that may still apply.

3. Pricing and Payment

• All prices are in United States Dollars (USD) and exclude applicable sales tax, shipping, handling, or delivery fees unless otherwise stated.
• We reserve the right to correct pricing errors. If a pricing error occurs, we may cancel the order or contact you for approval of the corrected price.
• Payment is due in full at the time of purchase (in-store) or upon order confirmation (online). Accepted payment methods include Venmo, Zelle, PayPal, or a credit card through the website. 
• You authorize us to charge the selected payment method for the total amount, including taxes and fees.

4. Orders and Order Confirmation

• Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason.
• An order confirmation email or receipt does not constitute acceptance; acceptance occurs when we ship the product or make it available for in-store pickup/delivery.
• We may cancel or refuse orders due to suspected fraud, pricing errors, product unavailability, or other legitimate business reasons.

5. Shipping, Delivery, and In-Store Pickup

• For online orders: Shipping times and costs are estimates only. Risk of loss passes to you upon delivery to the carrier (FOB shipping point).
• For in-store purchases or pickup: Title and risk of loss transfer upon payment and removal of the instrument from our premises.
• We are not responsible for delays caused by carriers, customs (for international orders), or events beyond our reasonable control.

6. Returns, Refunds, and Exchanges

• Used, vintage, consignment, or "as-is" instruments: All sales are final—no returns, refunds, or exchanges unless the item is materially different from the description provided.
• To initiate a return, contact us within the stated period. Return shipping costs are your responsibility unless the item is defective or not as described.
• Refunds are issued to the original payment method within 5 business days after we receive and inspect the returned item.

7. Warranties and Disclaimers

• Used instruments are sold without any warranty, express or implied, including the implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
• We do not warrant that products will meet your specific expectations or playing requirements.

8. Limitation of Liability 

To the maximum extent permitted by law, [Your Business Name], its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.

Any repair or setup work is subject to separate terms provided at the time of service. We are not responsible for damage resulting from misuse, neglect, unauthorized modifications, or normal wear and tear.

10. Intellectual Property

All website content, logos, photographs, and marketing materials are our property or licensed to us. You may not reproduce, distribute, or use them without our written permission.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Dallas County, Texas. You agree to submit to the personal jurisdiction of such courts.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted here with the revised "Last Updated" date. Continued use of our services or purchases after changes constitutes acceptance of the revised Terms.
